Terms of Service

1. Acceptance of Terms
By accessing or using Canmers ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, please do not use the Service. We may update these terms from time to time; continued use of the Service after changes constitutes your acceptance of the revised terms.
2. Description of Service
Canmers is an online invoicing and business management tool designed for Canadian small businesses. It allows you to create, manage, and export invoices, track customers, and manage products. The Service is provided "as is" and we reserve the right to modify, suspend, or discontinue any part of it at any time without notice.
3. Your Account
You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorized access. We are not liable for any loss or damage arising from your failure to protect your account.
4. Acceptable Use
You agree to use the Service only for lawful purposes and in a way that does not infringe the rights of others. You may not attempt to gain unauthorized access to any part of the Service, introduce malicious code, or use the Service to transmit unsolicited communications.
5. No Warranty
The Service is provided "as is" and "as available", without warranty of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components. We make no guarantees regarding the accuracy, reliability, or completeness of any content generated or stored through the Service.
6. Limitation of Liability
To the fullest extent permitted by applicable law, Canmers and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, loss of business, or any other financial or non-financial losses, arising out of or in connection with your use of — or inability to use — the Service.
We are not responsible for data loss under any circumstances. You are solely responsible for maintaining backups of any data you store in the Service. In no event shall our total liability to you exceed the amount you paid us, if any, in the twelve (12) months preceding the event giving rise to the claim. If you have not paid us anything, our liability is zero.
7. Indemnification
You agree to indemnify and hold harmless Canmers and its operators from any claims, damages, losses, or expenses (including reasonable legal fees) arising out of your use of the Service, your violation of these Terms, or your violation of any rights of a third party.
8. Third-Party Services
The Service relies on third-party providers including Clerk (authentication) and Neon (database hosting). Your use of the Service is also subject to those providers' own terms and privacy policies. We are not responsible for the practices or content of third-party services.
9. Termination
We may suspend or terminate your access to the Service at any time, for any reason, without notice or liability. You may stop using the Service at any time. Upon termination, your right to use the Service will immediately cease.
10. Governing Law
These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.
